Terms of Service

1. Acceptance of Terms

By accessing or using LegacyLists (“the Service”), operated by Testate Technologies Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will notify you of material changes via email or through the platform.

2. Eligibility

LegacyLists is designed for estate planning professionals, including solicitors, will writers, and registered estate planners. By creating an account, you confirm that you are authorised to act on behalf of your firm and that you meet any applicable professional registration requirements.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@legacylists.co.uk if you suspect any unauthorised use of your account.

You must provide accurate and complete information when creating your account and keep it up to date. Firm administrators are responsible for managing team member access and ensuring appropriate permissions are assigned.

4. Subscription & Billing

LegacyLists offers a subscription-based service priced per user per month. A 30-day free trial is available for new firms. Pricing may change; we will give you at least 30 days' notice before any price increase takes effect.

Payments are processed securely by Stripe. You authorise us to charge your chosen payment method on a recurring basis until you cancel. You may cancel your subscription at any time through your account settings; your access will continue until the end of the current billing period.

If a payment fails, we will attempt to collect the payment over a reasonable period before suspending your access. We do not store your full payment card details; these are held securely by Stripe.

5. Client Data & Intellectual Property

You retain ownership of all data and content you submit to LegacyLists, including client estate information, documents, and firm details (“User Content”). By using the Service, you grant us a limited licence to store, process, and display your User Content solely for the purpose of providing the Service.

You are responsible for ensuring you have appropriate consent or legal basis to process your clients' personal data through LegacyLists in accordance with applicable data protection laws.

All other content on the platform — including the software, design, text, graphics, and branding — is owned by Testate Technologies Ltd and protected by copyright and intellectual property laws.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws or professional regulations.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Upload malicious code, viruses, or any material designed to disrupt the Service.
  • Use automated tools to scrape, crawl, or extract data from the platform.
  • Share account credentials with individuals outside your firm.
  • Use the Service to store or transmit content that infringes the rights of others.

7. Limitation of Liability

LegacyLists is a practice management and estate organising tool. We do not provide legal, tax, or financial advice. Professional users remain solely responsible for the advice they give to their clients.

To the fullest extent permitted by law, Testate Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

8. Termination

You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you breach these terms, with reasonable notice where possible.

Upon termination, we will retain your data for 30 days to allow you to export it, after which it will be permanently deleted in accordance with our Privacy Policy.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
